If the Parties can agree upon the specifics of the divorce, including such things as distribution of the marital property, custody of the child (if applicable), then the parties may be able to file for divorce under the grounds of Irreconcilable Differences. This is what is commonly referred to as a No-Fault Divorce. Be sure you understand that even if you get a divorce by agreement, the Court Order is binding and cannot be changed without certain qualifications in the law.
If the parties cannot agree upon the specifics of a divorce, this becomes what is called a Contested Divorce. Each Contested Divorce is different, as each party’s situation is different. Many things may need to occur. Some examples are as follows:
Filing of a Complaint with the Court asking for a divorce and stating the grounds for which we may be entitled to that divorce;
List in the Complaint what items the Court needs to address, such as the division of property and the custody of children;
Temporary Hearing (if necessary): This is used to obtain temporary relief for the parties, such as temporary child support and custody and also temporary arrangement for the use of the martial property, until a full and final hearing can be conducted to determine these matters on a permanent basis.
Conduct Discovery: Discovery is where the parties are asked questions, either written or through oral depositions, in which that party is required to answer under oath.
